Court Provides List of 15 Customers Enjoined from Purchasing Liown’s Candles; All Other Customers Permitted to Purchase Moving Flame™
On May 22, 2015, the U.S. District Court for the District of Minnesota provided the following clarification about which customers are enjoined from purchasing Moving Flame™Plaintiff’s Motion for Preliminary Injunction [Doc. No. 50] is GRANTED:
- a. Defendants are enjoined from manufacturing, distributing, offering for sale, selling, or importing moving flameless candles to the following customers of Plaintiff Luminara:
- Ambient Lighting, Inc.
- Balsam Hill Christmas Tree Co.
- Bed Bath & Beyond, Inc.
- Brookstone Stores, Inc.
- Costco Wholesale co.
- Darice, Inc./Lamrite West, Inc.
- Frontgate
- GKI/Bethlehem Lighting
- Kohl’s Corp.
- The Light Garden
- Lowe’s Companies, Inc.
- One King’s Lane, Inc.
- PC Treasure, Inc.
- QVC, Inc.
- Williams-Sonoma Stores, Inc./Pottery Barn
- c. Except for the foregoing entities expressly identified herein, no other entities are enjoined by the Court’s April 20, 2015 Opinion and Order, and in addition, Defendants are not enjoined by the Court’s April 20, 2015 Opinion and Order from selling, offering to sell, or importing moving flameless candles to be sold to consumers in the general public.
